A real estate rental project relies on a sequence of technical, legal, and financial decisions, the order of which determines its success. Whether the rental concerns a tenant looking for housing or a landlord putting a property on the market, each step involves specific obligations, reinforced by several regulatory changes applicable from autumn 2026.
Resolutory clause and mandatory lease mentions in 2026
Most real estate rental guides detail the steps for searching or financing. Few address the modifications to the standard rental contract, which directly affect the legal security of both the landlord and the tenant.
Starting from October 1, 2026, residential leases concluded or renewed will include new mandatory mentions. The resolutory clause must specify the situations of payment default and the six-week period following a payment order that remains unsuccessful, according to ANIL.
The contract may also mention the phone numbers of the landlord and tenant, an addition aimed at facilitating the prevention of unpaid rents through direct contact. For landlords drafting their own leases, ensuring the document complies with the new standard contract becomes a priority before any rental is initiated.
At the same time, the judicial handling of unpaid rents is tightening. Since September 1, 2026, the notification period for a payment injunction order has been reduced from six to three months. After this period, the order becomes void. A landlord facing a payment default must therefore act more quickly than before to avoid losing the benefit of the procedure.
Before diving in, it is useful to explore rentals on Immorise to compare available offers and prepare one’s file in advance.

Tenant file and guarantees: the documents that make a difference
The rental file serves as the first selection filter, both for the tenant and the landlord. Its composition is regulated by law, but the quality of presentation and completeness of supporting documents often sway a candidacy.
The landlord can only require the documents stipulated by the regulations. Any request for bank statements, identity photos, or previous employer certificates is prohibited.
- Valid identity document (national identity card, passport, or residence permit)
- Current proof of residence (last three rent receipts, accommodation certificate, or property tax notice)
- Proof of professional situation (employment contract, Kbis extract for a self-employed person, Pôle emploi certificate)
- Proof of income (last three payslips, last tax notice, proof of social benefits)
A guarantor, or the Visale guarantee offered by Action Logement, strengthens the application. Visale covers unpaid rents and property damages for eligible tenants, at no cost to the landlord or tenant.
Rental profitability and property management: calculate before signing
For a landlord, the gross rental yield is calculated by dividing the annual rent by the property’s acquisition price, then multiplying by one hundred. This ratio provides an initial indicator, but it is not sufficient.
The net yield includes non-recoverable charges, property tax, property management fees (if the property is entrusted to a manager), and rental vacancy. A property rented eleven months out of twelve does not produce the same return as a continuously occupied property.
EPC and electrically heated homes
The energy performance diagnosis directly impacts the rental process. The electricity conversion factor in the EPC has been lowered, which may change the energy class of a property heated by electricity. A property rated F or G could, after re-evaluation, move to class E and remain rentable without renovations.
Having a new EPC carried out before renting out an electrically heated property helps avoid a rental ban based on an outdated classification.
Property management: self-managed or delegated
Managing a property directly involves drafting the lease, issuing receipts, handling repairs, and declaring rents. Delegated property management transfers these tasks to a professional, for a percentage of the rent collected, usually ranging between a few percentage points.
The choice depends on the available time and the number of properties. A landlord geographically distant from their property often finds it beneficial to delegate to ensure responsiveness in case of damage or unpaid rent.

Rent and regulation: check local rules
Several municipalities apply a rent control that caps the amount chargeable at the time of re-rental or lease renewal. Paris, Lyon, Lille, Montpellier, Bordeaux, and other affected municipalities publish annual reference rents by neighborhood and type of housing.
A landlord who sets a rent above the cap exposes themselves to a tenant’s appeal before the departmental conciliation commission. The tenant, for their part, can verify the compliance of the proposed rent using the rent sheets published by local observatories.
The compliance of the rent, the validity of the EPC, the drafting of the lease according to the current standard contract, and the establishment of a complete file form a technical foundation that neither the landlord nor the tenant can overlook. Any missing document or non-compliant clause can delay the signing or even invalidate the contract afterward.
